Terms of Service and Author Bill of Rights 

By choosing to collaborate with Falena Publishing, you agree to abide by our terms. Falena Publishing operates as a publishing service provider, offering the services outlined on our Pricing page. The fees for these services might undergo occasional adjustments depending on the length of your book and its complexity.

To stay informed about our services, it is your responsibility to maintain an updated mailing address in our records, and ensure continued subscription to our mailing list using a valid email address.

A) Author Rights and Responsibilities

As an author partnered with Falena Publishing, you will:

  1. Have a dedicated Author Manager as your primary point of contact until 30 days post-publication. Subsequent communications will be facilitated through our Post-Publication Support form or via email at: authorsupport@falenapublishing.com.
  2. Retain complete ownership (100%) of your content and any assigned ISBNs once full payment is made. This ownership encompasses all files we generate for your material.
  3. Exercise complete control (100%) over the file creation process.
  4. Receive full royalties generated from the sales of your material, detailed calculation methods for print royalties here and eBook royalties here.
  5. Be responsible for submitting your own work through the platforms we recommend and following our guidelines.
  6. Rest assured that your manuscript and intellectual property will not be shared with third parties.
  7. Verify your ownership or control of the necessary rights for your material. You agree to indemnify us against any costs related to claims against this warranty or any other claims arising from the publication of your material.
  8. If paying in installments, these payments will be automatically deducted on the same day monthly until the full payment is made. Failure to make timely payments may result in suspension of your book’s distribution with prior notice.
  9. Refunds: If you’re not completely satisfied with the files we produce, we’ll collaborate until you are satisfied. However, a refund can only be made during the first 30 days of signing up with us, in all services except cover design and editing. Cover design and editing are exhaustive tasks that cannot be refunded. 
  10. Editing suggestions and corrections have to be accepted by the authors, however, it has to be taken into account that editing can be subjective for the authors and suggestions can be rejected if the author does not feel they correspond to the narrative. 
  11. Your approval of files signifies satisfaction, including approving front cover designs, sample layouts, and/or illustration sketches. 
  12. Once all the package has been delivered, the book project is considered finished and the provision of the service, too. The relationship between Falena and the authors can continue as guidance through materials and phone calls or emails. Falena is not responsible for the amount of the sales or the lack of sales of a book. Success cannot be guaranteed.
  13. We encourage you as an author to build a relationship with your audience. 
  14. Authors have to be over 18 years old to publish with us. If the Author is under age, a waiver has to be signed by a guardian. 

B) Author Code of Conduct While collaborating with Falena Publishing, you commit to:

  1. Maintain respectful and professional communication at all times. We do not tolerate offensive language, shouting or disrespectful ways of communicating.
  2. Refrain from using abusive, harmful, or offensive language at all times.
  3. Opt for consolidated emails whenever feasible.
  4. Elect a single spokesperson if your project involves multiple contributors.
  5. Adhere to our production timelines, acknowledging that your responsiveness, project complexity, and special requests may impact these timelines. 
  6. Observe our communication timelines:
  • Expect a 1-2 business day response time from your Author Manager for emails.
  • Anticipate a 1-3 business day response time from our Post-Publication Support Team for emails.
  • For Premium Authors: Schedule phone calls with your Author Manager through appointments only.

C) Falena Publishing – Rights and Responsibilities 

We retain the authority to decline any manuscript or withdraw from distribution any book that:

  1. Promotes hate or incites violence toward any individual or group based on factors like race, religion, sex, or sexual orientation.
  2. Is entangled in legal disputes with third parties.
  3. Otherwise poses a risk to our brand, at our sole discretion.

We reserve the right to terminate our collaboration with you for violations of our Author Code of Conduct. Upon termination, all files will be returned to you per the guidelines outlined in Paragraph A(2), and you maintain the right to republish your work. We will remove our company name from the copyright, since we won’t be responsible for your work. 

Once we’ve delivered your material to you as a package, our service is deemed completed. Falena Publishing bears no liability if your material is rejected, delayed, or inaccurately displayed by any Distributor for any reason.

We reserve the right to update this Agreement.

D) Additional Considerations:

  1. In the event of disputes regarding this Agreement, the prevailing party has the right to collect reasonable costs and attorneys’ fees incurred in enforcing it.
  2. Limitation of Liability: We cannot be held responsible for various kinds of damages or losses that may arise from your use of our services, including direct, indirect, special, or incidental damages. This includes potential data loss, revenue, profits, or harm to your reputation. Our liability is limited, and in no event will it exceed the total fees paid by you to us in the three months prior to any claim being made.
  3. Indemnity: You agree to protect, compensate, and release Falena Publishing and our affiliates, along with our officers, directors, employees, and agents, from any claims, damages, losses, costs, or expenses, including legal fees. This includes instances related to your use of our services, your books, or any violation of the terms outlined here. If we face legal action due to your actions, you’re responsible for the costs and any damages incurred.

Privacy Policy

This privacy policy sets out how Falena Publishing uses and protects any information that you give to Falena Publishing when you use this website. Falena Publishing is committed to ensuring that your privacy is protected and that it will not reach any other party apart from us. Should we ask you to provide certain information by which you can be identified when placing an order, you can be assured that it will only be used in accordance with this privacy statement and it will not be sold, rented or shared. Falena Publishing may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

What information do we collect?

We collect information from you when you fill out a form or you try to contact us. When ordering on our site, you will be asked to enter your name and contact information including e-mail address and if you are paying for a service, payment information. You may, however, visit our site anonymously.

How do we handle payments?

The website offers the option to buy specific goods or services. Should you decide to make a purchase, we’ll need enough details from you to finalize the transaction. This could entail providing a credit card number, relevant account details, billing information, invoice specifics, and any other necessary data to fulfill your order. In cases where we use third-party tools, software, or services to handle transactions on our behalf, you acknowledge and agree to abide by the terms of use and privacy policy of those third-party service providers.

 The information we gather from you can be utilized in the following manners:

  • Processing transactions: Your information, whether publicly available or private, won’t be sold, swapped, transferred, or disclosed to any other entity without your explicit consent. This is solely done to fulfill the requested service.
  • Sending occasional emails: The email address you provide during order processing might be used to convey order-related updates and information. Additionally, you may occasionally receive company news, updates, related product or service information, and similar content.

 Our commitment lies in ensuring the security of your information. To prevent unauthorized access or disclosure, we’ve implemented appropriate physical, electronic, and managerial measures. These procedures aim to safeguard and secure the online information we gather.
